Commercial use of premises

The right location and ideal premises are key to the success of your business.

Are the location and surrounding environment suited to your business? A restaurant, café, food shop, or fashion boutique have very different criteria to a nursery, engineering firm, yoga studio, or online shop. Identify which location factors are important to you, such as:

  • Proximity to customers/suppliers
  • Transport links
  • Parking spaces
  • Rent levels
  • Building size, condition, and facilities
  • Environmental issues such as protection from noise
  • Proximity to other highly frequented locations
  • Purchasing power and sales potential
  • Distance to and appeal of competitors
  • Size and scale of the catchment area
  • How will the location develop in the future?

What you need from your premises

The type and size of premises you need depends very much on your business. A shop needs a certain layout and sufficient window space. If you plan to open a physiotherapy practice, you will want rooms at ground level or accessible by elevator. Do you need a shop floor/workshop, storage space, office space, or can you work from home?

You also need to consider building, fire protection, and industry-specific regulations such as requirements for practices and rooms in which some form of childcare is offered, or  food hygiene regulations for anyone planning to store, process or sell food.

Tip: Rental contracts for commercial premises are often very different to apartment rental contracts.

Many entrepreneurs start working from home and set up a special room in their apartment or house. You should inform your landlord about this. You should also find out from the Amt für Wohnen und Migration (Housing and Migration Office) whether you are even allowed to use your home for business purposes or whether you need a permit to do so. If you are a home owner, you should also obtain approval for working from home in case of doubt.

Tip: In some cases your work room at home can be deducted from your taxes. Ask a tax adviser!
