The Viability Review Process
The legal requirements for your business plan evaluation differ significantly depending on your business classification:
For Commercial Businesses (Gewerbe): By law, the authorities are strictly required to consult expert bodies to evaluate whether there is an “economic interest” or a “regional need” for the business, as well as a positive impact on the economy. The Munich Service Office for Immigration and Citizenship will automatically forward your business plan to the local Chamber of Commerce and Industry (IHK) for this mandatory viability check. The IHK will evaluate your plan and send its official statement directly back to the authorities. Depending on your industry, this assessment may also involve other competent expert bodies, such as the Chamber of Skilled Crafts (HWK Handwerkskammer für München und Oberbayern).
For Liberal Professions (Freier Beruf): These strict external checks generally do not apply. The authorities evaluate your application directly based on your personal professional qualifications, degrees, and financial sustainability. However, if your activity falls under a regulated “Kammerberuf” (such as doctors, lawyers, or architects), your respective professional chamber must be involved to verify your license to practice.
Important: You cannot apply to these expert bodies for a viability check yourself. This internal review process is managed solely and automatically by the Munich Service Office for Immigration and Citizenship.
